Your privacy is important to us. This policy describes how We're Called Ed collects and processes your personal data in accordance with the GDPR.

1. Parties and scope

Ed establishes this Privacy Policy, which aims to inform Users in a transparent manner about the website hosted at www.werecalleded.be (hereinafter the "Site"), and about the manner in which personal data is collected and processed by Ed.
The term "User" refers to any user, whether a natural or legal person, who visits the Site or communicates with the Site in any way whatsoever.
In its capacity as data controller, Ed determines all technical, legal and organisational means and the purposes for the processing of Users' personal data. Ed undertakes to take all necessary measures to ensure that the processing of personal data takes place in accordance with the Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (hereinafter the "Law") and Regulation (EU) 2016/679 (i.e. the General Data Protection Regulation or 'GDPR'; hereinafter the "Regulation").
Ed is free to choose a natural or legal person to process users' personal data on its request and in its name (hereinafter the "Processor" or "Subcontractor", such as the provider of the website platform or newsletter software). Ed selects only Processors that offer sufficient guarantees in accordance with the Law and the Regulation.
2. Processing of personal data
The use of the Site by Users may lead to the collection of personal data. The processing of this data by Ed, or by service providers acting on behalf of and for the account of Ed, takes place in accordance with the Law and the Regulation.
Personal data is collected and processed through the following methods: newsletter subscriptions, filling in contact or booking forms and interactions via social media.
3. Purpose of processing personal data
In accordance with Article 13 of the Regulation, the purposes of processing personal data are communicated to the User. These purposes are:
• Processing requests, quotes and bookings.
• The administrative and financial handling of delivered services.
• Sending updates about our offerings, new acts and events (via the newsletter).
Important note regarding communication: We're Called Ed acts as the umbrella organisation for several of our own acts and concepts. When you give consent for communication via our forms or newsletter, you agree that you may receive relevant updates from us. This communication may come from the general email address of We're Called Ed (e.g. info@werecalleded.be), but may also, depending on the subject or the specific act for which you showed interest, be sent from an email address specifically linked to one of our acts.
4. Personal data that may be processed
The User agrees that, during the visit and use of the Site, Ed may collect and process the following personal data:
• Identification data (name, first name, company name, KBO number)
• Contact data (email address, phone number, postal address)
• Data relating to the request (date and location of the event)
• Technical data (IP address and browsing behaviour via cookies, see Article 9)
5. Consent
By accessing and using the Site, the User declares that he/she has read and given his/her free, specific, informed and unambiguous consent for the processing of his/her personal data.
Consent is given by the positive and active act by which the User submits a form on the Site, or checks a box for the privacy policy.
The User has the right at any time to withdraw this consent. The withdrawal of consent (for example unsubscribing from the newsletter) does not affect the lawfulness of the processing based on the prior consent.
6. Retention period of personal data
In accordance with Article 13, paragraph 2 of the Regulation, the Data Controller retains personal data only for as long as is reasonably necessary to achieve the purposes for which it is processed:
• Data linked to bookings and invoices is retained for 7 years (statutory accounting retention obligation).
• Contact data obtained via information requests (without a resulting booking) is retained for a maximum of 2 years after the last contact.
• Data for the newsletter is retained until the User unsubscribes or withdraws their consent.
7. Recipients of data and disclosure to third parties
Personal data may be passed on to employees, subcontractors or suppliers of Ed insofar as they collaborate in providing our services. They act under the direct authority of Ed.
In the event that the data is provided to third parties for direct marketing purposes, the User will be informed in advance so that he or she can give prior and explicit consent for this use.
8. User rights
The User may exercise their rights at any time by sending an email to info@werecalleded.be, or by post to Rode Molenstraat 48, 2800 Mechelen.
a. Right of access
The User has the right to access their personal data and information about its processing.
b. Right to rectification
Incorrect, inaccurate or irrelevant data may be corrected or deleted at any time.
c. Right to erasure (right to be forgotten)
The User has the right to obtain the deletion of their personal data as soon as possible, unless retention is necessary to comply with a legal obligation (such as the fiscal retention obligation).
d. Right to restrict processing
The User has the right to a restriction of processing in the cases referred to in Article 18 of the Regulation.
e. Right to data portability
Users have the right to receive their personal data from Ed in a structured, commonly used format.
f. Right to object
The User has the right at any time to object to the processing of their personal data for prospecting purposes (direct marketing).
g. Right to complain
The User has the right to lodge a complaint with the Data Protection Authority (Drukpersstraat 35, 1000 Brussels, contact@apd-gba.be).
9. Cookies
The Site uses cookies to offer Users a better browsing experience and to improve the Site.
a. General principles
A "Cookie" is a file that is temporarily or permanently placed on the User's device. Cookies may also be installed by third parties with whom Ed collaborates.
b. Types of cookies
• Technical/Functional cookies: Necessary for the operation of the Site.
• Analytical/Tracking cookies: Ed uses analytics (such as Google Analytics) to measure interaction and produce anonymous statistics to improve the Site.
c. Cookie management
The User can easily manage, refuse or delete cookies by adjusting their browser settings or via the cookie banner on the Site. If the User disables cookies, the Site may not function optimally.
10. Limitation of liability
The website may contain links to third-party websites. The content of these sites is not the responsibility of Ed. Ed is also not responsible for the collection and processing of data of minors under 16 years of age whose consent is not effectively covered by that of their legal parents. Ed is not responsible for the theft of personal data as a result of cyberattacks or viruses, despite the security measures taken.
11. Security and protection
The Data Controller implements technical and organisational measures to ensure an appropriate level of security for the processing and collection of data, and uses standard encryption technologies (such as SSL/HTTPS) when transferring data on the Site.
12. Changes to the Privacy Policy
Ed reserves the right to modify this Privacy Policy in order to comply with legal obligations. The User is requested to consult the Privacy Policy regularly.
13. Applicable law and competent court
This Privacy Policy is governed exclusively by Belgian law. Any dispute will be submitted to the competent courts of the district of Antwerp, division of Mechelen.
